Welcome to Mistables! Mistables is a brand owned and operated by Imagine Technologies, Inc. The terms “Mistables,” “we,” “us” and “our” refer to Imagine Technologies, Inc.

We operate this store and website, including all related information, content, features, tools, products and services, to provide our customers with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (the “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

When you place an order, you are making an offer to purchase. We reserve the right to accept, decline, limit or cancel an order for any lawful reason.

An order is not accepted until we confirm acceptance and successfully process payment. Please review your order carefully before submitting it because we may be unable to accommodate changes or cancellations after processing begins.

If we decline, change or cancel an order, we will attempt to notify you using the email address, billing address or telephone number supplied with the order.

Prices, discounts and promotions may change without notice. The price charged will be the price in effect when the order is placed and will be shown in the order confirmation.

Unless otherwise stated, displayed prices do not include applicable taxes, shipping, handling, customs duties or import charges.

Prices offered through our online store may differ from prices offered through third-party retailers. Promotional offers may be governed by separate terms. If promotional terms conflict with these Terms, the promotional terms will control for that promotion.

Shipping and delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs processing, incorrect customer information or events outside our reasonable control.

To the extent permitted by law, title and risk of loss pass to you when the order is transferred to the shipping carrier.

Without our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store or transmit material from the Services except as permitted by law.

Nothing in these Terms grants you a license or other right to use the intellectual property of Mistables, Imagine Technologies, Inc., Shopify or any third party. All rights not expressly granted are reserved.

The Mistables name, logos, product names, designs and slogans—including Wellness in Every Mist™—are trademarks or intellectual property of Imagine Technologies, Inc. or its licensors and may not be used without prior written permission.

Shopify’s names, logos, products and services are trademarks of Shopify. Other names, logos and marks appearing through the Services belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

The Services may provide access to tools or features operated by third parties that we do not monitor or control.

Access to such tools is provided “as is” and “as available,” without warranties, representations, endorsements or conditions of any kind. Your use of third-party tools is at your own risk and subject to the applicable provider’s terms and policies.

New features, tools or resources offered through the Services in the future will also be governed by these Terms.

Mistables is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Imagine Technologies, Inc.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Mistables, including injury, damage or loss resulting from products or transactions. To the extent permitted by law, you release Shopify and its affiliates from claims, damages and liabilities arising from or relating to your purchases from Mistables.

  • You own or have the necessary rights to the Feedback.

  • You have disclosed any compensation or incentive received in connection with it.

  • The Feedback is truthful and complies with these Terms.

  • The Feedback does not violate any third party’s intellectual-property, privacy, publicity or other rights.

  • The Feedback does not contain unlawful, abusive, defamatory, obscene or malicious content or harmful software.

We are not required to keep Feedback confidential, pay compensation for it or respond to it. We may monitor, edit or remove Feedback that we determine violates these Terms or is otherwise objectionable.

You may not use a false identity or misrepresent the origin of Feedback. You remain responsible for the accuracy and legality of the content you submit.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information presented through the Services may occasionally contain typographical errors, inaccuracies or omissions involving product descriptions, prices, promotions, shipping charges, delivery estimates or availability.

We may correct errors, update information or cancel orders affected by inaccurate information at any time, including after an order has been submitted, subject to applicable law.

Agents must not conceal their automated nature, imitate human behavior to evade detection, circumvent CAPTCHAs or bypass measures intended to control automated access.

We may restrict or block Agent access at any time.

We may terminate these Terms or suspend access to the Services if you violate these Terms or engage in conduct that threatens the security, integrity or lawful operation of the Services.

You remain responsible for amounts owed through the date of termination.

Provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, governing law and other provisions that by their nature should survive will remain in effect after termination.

To the fullest extent permitted by law, Imagine Technologies, Inc., Mistables, our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors—and Shopify and its affiliates—will not be liable for indirect, incidental, punitive, special or consequential damages, including lost profits, lost revenue, lost savings, loss of data or replacement costs, arising from or relating to your use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

SECTION 18 — INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify, defend and hold harmless Imagine Technologies, Inc., Mistables, Shopify and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from third-party losses, damages, liabilities or claims, including reasonable attorneys’ fees, arising from:

  • Your material breach of these Terms.

  • Your violation of applicable law.

  • Your violation of another party’s rights.

  • Your unlawful or unauthorized access to or use of the Services.

We will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will not relieve your obligations unless the delay materially prejudices your defense. We may control the defense and settlement of the claim, and you agree to provide reasonable cooperation.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed as necessary. The remaining provisions will remain valid and enforceable.

Our failure to enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and the policies referenced herein constitute the entire agreement between you and us concerning the Services and supersede prior or contemporaneous communications and proposals relating to the Services.

These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of California, without regard to conflict-of-law principles.

Subject to mandatory consumer protections that may apply, legal proceedings arising from these Terms or the Services shall be brought in the applicable state or federal courts located in Ventura County, California.
